{"id":73,"date":"2020-06-25T14:10:10","date_gmt":"2020-06-25T18:10:37","guid":{"rendered":"https:\/\/www.adelphi.edu\/international-services\/?page_id=73"},"modified":"2026-09-29T12:48:02","modified_gmt":"2026-09-29T16:48:02","slug":"dhs-rule-changes","status":"publish","type":"page","link":"https:\/\/www.adelphi.edu\/international-services\/immigration\/dhs-rule-changes\/","title":{"rendered":"DHS Rule Changes"},"content":{"rendered":"<h2>The DHS Final Rule is Currently Blocked<\/h2>\n<p>The rule was scheduled to take effect on September 15, 2026. <strong>Because of a national preliminary injunction, implementation is delayed while the litigation continues.<\/strong><\/p>\n<p>For now:<\/p>\n<ul>\n<li>The existing Duration of Status (D\/S) framework remains in effect<\/li>\n<li>The new fixed-period admission requirements are not currently in effect<\/li>\n<li>Students do not need to take action solely because of the blocked Final Rule<\/li>\n<li>Existing requirements governing F-1 transfers, changes of educational level, program extensions, and practical training continue to apply<\/li>\n<\/ul>\n<h3>What Happens Next?<\/h3>\n<p>The preliminary injunction temporarily pauses implementation of the rule; it does not permanently resolve the legal challenge. Further court proceedings are expected, and the rule could be modified, reinstated, or otherwise affected as the case proceeds.<\/p>\n<p>International Services will continue to monitor the litigation and any guidance issued by DHS and will provide additional updates as they become available.<\/p>\n<h3>What You Should Do<\/h3>\n<p><strong>No immediate action is required<\/strong> based solely on this court decision. Continue to follow your current F-1 or J-1 requirements and existing International Services guidance.<\/p>\n<h3>What Adelphi Is Doing<\/h3>\n<p>The Office of International Services has been preparing the university for potential changes since the final rule was proposed and continues to closely monitor developments and review new information as it becomes available. This work includes:<\/p>\n<ul>\n<li>Monitoring federal regulations, agency guidance and legal developments and assessing their impact on F-1 and J-1 students and scholars<\/li>\n<li>Providing individualized immigration advising and monitoring student and scholar status, program timelines and compliance requirements<\/li>\n<li>Providing targeted guidance to students, exchange visitors, academic and administrative units and University leadership<\/li>\n<li>Reviewing policies, procedures, programs and processes and coordinating with departments on compliance needs<\/li>\n<li>Coordinating with Admissions, Advisement, academic units and administrative offices to support consistent guidance and messaging<\/li>\n<li>Assessing potential effects on students, scholars, academic programs and University operations and preparing appropriate responses<\/li>\n<li>Providing communications, FAQs, resources, workshops, webinars and training as needed<\/li>\n<li>Reviewing and updating policies, procedures, forms, systems, admission materials, web content and other communications as needed<\/li>\n<li>Reviewing and strengthening guidance related to transfers, changes of educational level, program extensions and other academic mobility matters<\/li>\n<\/ul>\n<h3>About the DHS Final Rule<\/h3>\n<p>On July 17, 2026, <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/17\/2026-14439\/establishing-a-fixed-time-period-of-admission-and-an-extension-of-stay-procedure-for-nonimmigrant\" target=\"_blank\" rel=\"noopener\">DHS published the final rule<\/a>, <em>Establishing a Fixed Time Period of Admission and an Extension of Stay Procedure for Nonimmigrant Academic Students, Exchange Visitors, and Representatives of Foreign Information Media<\/em>. The rule would replace the longstanding duration of status (D\/S) framework with fixed periods of admission of no more than four years.<\/p>\n<p>For F-1 students, the rule would make significant changes related to:<\/p>\n<ul>\n<li>Admission periods<\/li>\n<li>Program extensions<\/li>\n<li>School transfers<\/li>\n<li>Changes of educational level<\/li>\n<li>Changes of major<\/li>\n<li>Academic progression and mobility<\/li>\n<li>Grace periods<\/li>\n<li>Extension of stay procedures<\/li>\n<\/ul>\n<p>The rule was scheduled to take effect on September 15, 2026, but implementation is currently blocked by the preliminary injunction.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The DHS Final Rule is Currently Blocked The rule was scheduled to take effect on September 15, 2026.
